Annexe to Adaptavist EULA for ScriptRunner Migration Suite (SMS)

These terms supplement and are incorporated by reference into the terms of the Adaptavist EULA. You agree as follows:

To ensure a great user experience and service reliability for all users of ScriptRunner Migration Suite, the app is subject to a fair use policy. Given the variable resource use of the product we are not able to set specific limits on the fair use of the product. The determination of usage which falls out of our definition of “Fair Use” is solely at the discretion of Adaptavist.

You agree that if your usage falls outside of “Fair use” Adaptavist may terminate or throttle your usage, or take other measures as it deems appropriate to maintain the overall service levels for the product.

You acknowledge and agree that in relation to the ScriptRunner Migration Suite (i) there is no guarantee of no data loss for ScriptRunner Migration Suite and (ii) we reserve the right to make underlying technical platform changes including platform(s) migration, which may impact the level of service and availability, or require you to migrate or re-create your data, or cause some data loss.

The Product uses artificial intelligence services from Anthropic and potentially other vendors and shares Your Data with the external service(s) to provide its functionality and outputs to you, and therefore you acknowledge and agree that applicable terms in relation to artificial intelligence, notably regarding Your Data and the Generated Content, from the Adaptavist EULA, apply.

You agree to use the Product in accordance with the applicable terms and usage policies of Anthropic: https://www.anthropic.com/legal/aup.

You agree to use the Product only in the countries listed in Anthropic Supported countries & regions Anthropic Commercial API access)

AI output is provided "as is" and may contain inaccuracies or incomplete information. You agree to independently evaluate and verify any output from the Product before use or reliance on the output. We make no representations or warranties and provide no indemnities with respect to the output of the Product, which is not intended to substitute for professional advice.

Permitted usage:

Notwithstanding terms of section 15 "Restrictions" of the Agreement, if you have procured a Professional edition license as stated on the applicable ordering document with Adaptavist, you are permitted to use the Product in relation to professional consultancy services which you provide to third parties such as your end customers.
